Extraterritoriality.
I resumed negotiations on March 25th and
communicated to Minister for Foreign Affairs substance of first ten paragraphs of your telegram No. 35 sub- mitting redrafts where called for. I also took the
opportunity to hand in redraft of article 1 (transfer of jurisdiction) contained in your tel egram No. 19 with opening words "except in criminal cases" reinserted and 2 paragraphs about lawyers and interpretation (already dealt with) deleted. Minister for Foreign Affairs was fairly receptive, but as usual would not commit him- self at once, and your amendments and redrafts will now be discussed in detail by Mr. Teichman and Hsu No,
2. I did not raise point about legal counsellor's observing courts trying cases in which British subjects are plaintiffs (see paragraph 2 of your telegram No. 35) and do not propose to do so unless further instructed. There appears to be some misunderstanding. Only cases in which British subjects are defendants will come before special Chambers and it is only to special Chambers that legal counsellors will be attached, To go back now and ask that legal counsellors should also observe other courts seems illogical and
